ANALISIS HUKUM PERTANGGUNG JAWABAN PIDANA TERHADAP TINDAK PIDANA PENIPUAN BISNIS ONLINE
Abstract
Kejahatan penipuan saat ini semakin berkembang seiring dengan perkembangan zaman dan kemajuan teknologi. Hukum dibuat untuk mengantisipasi hal tersebut, namun peraturan yang ada tampaknya tidak mengurangi kejahatan ini, melainkan justru meningkatkannya. Penelitian ini bertujuan untuk: (1) Menetapkan pertanggungjawaban pidana terhadap pelaku penipuan bisnis online; (2) Mengetahui faktor-faktor penyebab terjadinya penipuan bisnis online; dan (3) Mengkaji upaya pencegahan terhadap penipuan bisnis online. Jenis penelitian ini adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan menelaah bahan pustaka atau data sekunder. Hasil penelitian menunjukkan bahwa tindak pidana penipuan berbasis transaksi elektronik dipengaruhi oleh tiga faktor, yaitu budaya, pendorong (motivator), dan ekonomi. Oleh karena itu, terdapat upaya pencegahan penipuan bisnis online dengan pendekatan persuasif (sosialisasi kepada masyarakat) melalui pembuatan poster peringatan baik secara digital maupun non-digital terkait penipuan bisnis online. Selain itu, penegakan hukum terhadap tindak pidana penipuan ini masih dapat diakomodasi oleh Kitab Undang-Undang Hukum Pidana (KUHP) serta Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, serta Pasal 378 KUHP tentang penipuan.
