PENERAPAN RESTORATIVE JUSTICE TERHADAP ANAK SEBAGAI PELAKU PENCURIAN
Abstract
Keadilan restoratif merupakan pendekatan yang terjadi di luar sistem peradilan pidana. Pendekatan ini melibatkan korban, pelaku, keluarga korban dan pelaku, masyarakat, serta pemangku kepentingan yang berkepentingan dengan kejahatan tersebut. Tujuannya adalah untuk mencapai kesepakatan dan solusi yang mempertimbangkan kebutuhan semua pihak yang terlibat. Apabila anak menjadi pelaku pencurian, maka restorative justice diterapkan melalui proses mediasi dan negosiasi. Proses ini melibatkan pelaku, korban, keluarga pelaku dan korban, masyarakat, dan penegak hukum. Melalui mediasi dan negosiasi, kami bekerja sama untuk mencapai kesepakatan yang menguntungkan semua pihak.
